Fair Use Policy
1. About this Policy
This Fair Use Policy sets out how Hiaitus Pty Ltd (Hiaitus, we, us) expects users to use Checked It, the AI-assisted advertising compliance pre-screening platform available at www.checkedit.ai (the Service).
The Policy has two purposes:
- to give every user clear, fair limits that reflect typical marketing and regulatory workflows; and
- to protect service quality, platform stability and our proprietary AI models for the benefit of all users.
This Policy is incorporated by reference into the Checked It Terms and Conditions. Defined terms in the Terms and Conditions have the same meaning here. A material violation of this Policy is a material breach of the Terms and Conditions and may result in suspension or termination of your access to the Service.
Checked It is built for Australian marketers across regulated sectors, including alcohol, gambling and supplements. Our systems are optimised for human-led use by marketing and compliance professionals. Automated scraping or programmatic access to the Service outside of plans that expressly include API access is not permitted.
2. Acceptable Fair Use
2.1 Subscription Plan limits

2.2 How Subscription Plan limits work
- Limits are per account, not per seat. All seats on the account (admin, included team seats, and any additional purchased seats) draw from the same monthly pool.
- Limits reset on the first day of each billing month.
- Unused reports do not roll over to the next month.
- If you reach the cap before the end of a billing month, you may contact us to discuss a one-off top-up or a tier upgrade.
2.3 Report Package usage
Report Packages are credits-based and operate differently from Subscription Plans:
- Each Report Package contains a fixed number of credits (5, 10 or 25).
- There is no daily cap on credit use; you may run reports at the pace your workflow requires.
- Credits expire on the expiry date applicable to the package, as set out in the Terms and Conditions.
- Unused credits expire on that date and are not refundable.
- Report Packages do not auto-renew. To continue using the Service after credits expire, you may purchase a new Package or move to a Subscription Plan.
2.4 Good-faith spikes
The Service is intended to absorb the normal rhythm of marketing work, including occasional bursts around campaign launch days, regulator deadlines or seasonal pushes. Where usage spikes for genuine business reasons, we will work with you in good faith before taking any enforcement action.
3. Monitoring and compliance
To protect service quality and detect abuse or unintentional overuse, we monitor:
- frequency and volume of report submissions;
- IP address and session anomalies; and
- behaviour inconsistent with the plan, including patterns consistent with automated access on plans that do not include API rights.
Where we identify activity that is inconsistent with this Policy, we will:
- notify the relevant user prior to any enforcement action wherever practicable;
- allow for good-faith spikes; and
- offer upgrade, top-up or support options where genuine usage has scaled.
4. Enforcement actions
If usage continues to fall outside this Policy after notice, or where conduct is serious enough to warrant immediate action, we may:
- rate-limit or throttle usage on the account;
- issue an email warning or apply a temporary suspension; or
- for serious or repeat violations, terminate the Service in line with the Terms and Conditions.
We aim for proportionality. Minor or first-time breaches will not result in harsh penalties.
5. User obligations
You must:
- use the Service only for the regulatory compliance assessment of your own or your client's creative content;
- not sub-license, resell, rent, lease or otherwise commercially redistribute access to the Service unless expressly permitted in writing;
- not extract, reproduce, scrape, mirror, reverse-engineer or republish the Outputs as generic legal advice, as a competing dataset, or as a standalone product; and
- not use the Service to develop, train, fine-tune, benchmark or evaluate any competing product.
You must also comply with the Terms and Conditions, including the mandatory human review requirement in clause 3.2 of the Terms and Conditions.
6. Privacy and security
Any monitoring under this Policy is conducted in accordance with:
- the Hiaitus Privacy and Data Policy;
- the Privacy Act 1988 (Cth) and the Australian Privacy Principles; and
- any other applicable consumer and data protection laws.
We do not access uploaded creative content for purposes other than:
- providing and supporting the Service;
- policy enforcement under this Policy;
- model tuning and quality improvement; and
- anonymised benchmarking,
each as further described in the Privacy and Data Policy.
7. Policy changes
We may update this Policy from time to time to reflect:
- regulatory changes (for example, updates from the ABAC Adjudication Panel, AANA Codes, the TGA, ACMA, ACCC or FSANZ);
- usage patterns across the Service; and
- platform upgrades and new features.
We will give reasonable notice of any material change. Notice may be given by updating the Policy at www.checkedit.ai/fair-use-policy and notifying you by email or in-Service notice. Your continued use of the Service after the effective date of the change constitutes acceptance of the updated Policy.
8. Need higher volume?
If your team's regulatory review volume regularly exceeds the limits in section 2, contact us. We will work with you to find the right structure, whether that is a top-up, an additional seat allocation, or a custom arrangement for higher-throughput workflows.
